These Terms & Conditions ("Terms") govern your access to and use of Artist Diary, a service provided by Desire Software Technology LLP. By creating an account, using the app, buying a subscription, connecting with another profile, or using any Artist Diary service, you agree to these Terms. You must be at least 18 years of age to use this service, or have the consent of a parent or legal guardian. Continued use of Artist Diary after any updates to these Terms means you accept the updated Terms.
1. Eligibility & Conduct
Our goal is to provide a professional and safe environment for artists. To help us maintain this:
- You must be at least 18 years old to use Artist Diary, or have the consent of a parent or legal guardian.
- You agree to provide accurate information when creating your profile.
- You will not impersonate another person, artist, organization, or any other entity on the platform.
- You will not use automated tools, bots, scripts, or any non-human means to access, scrape, or interact with Artist Diary.
- You will not use the platform for any illegal activities or to upload, store, send, or distribute prohibited content, including malicious files, misleading material, sexual content, nudity, or harmful photos, videos, PDFs, or documents.
- We reserve the right to restrict, suspend, block, or permanently remove accounts that violate these professional standards or create risk for other users, our company, or our service providers.
2. Data Security Commitment
We take the security of your professional diary seriously:
- We use an encrypted login system to prevent unauthorized access.
- We do not share your private data with third parties without your explicit permission.
- We strive to maintain high security, though no digital system is entirely without risk.
- Any identity document photos and bank details you choose to store in Artist Diary are kept as your own personal records with additional encryption. We do not access, view, or use this information for any purpose other than securing it for you.
- You are responsible for keeping your login credentials confidential. Do not share your password or allow others to access your account.
- If a security incident occurs that affects your personal data, we will notify affected users promptly and take all reasonable steps to address the issue.
3. Subscription Plans, GST & Payments
Artist Diary may offer paid subscription plans with different features, limits, validity periods, storage access, sharing options, or usage limits. The plan details shown inside the app or on our official website at the time of purchase will apply to your account.
- Inclusive Pricing: All subscription prices shown to you are inclusive of applicable taxes, including GST where applicable. We do not charge GST separately from the displayed plan price.
- Non-Refundable Payments: Subscription payments are non-refundable once the plan is purchased, activated, renewed, or used, except where a refund is required by applicable law or a mandatory payment/platform policy. This is because payment gateway charges, platform costs, service access, and applicable GST may be processed immediately.
- Payment Gateway: Payments may be processed through Cashfree Payment Gateway or another authorized payment provider. Your payment details are handled by the payment provider as per its own terms and privacy practices.
- Plan Limits: We may apply fair usage limits, file-size limits, storage limits, upload limits, export limits, connection limits, or feature limits based on your selected plan. If you exceed your plan limits, some features may be paused until you upgrade, renew, reduce usage, or contact support.
- Cancellation: Cancelling a subscription stops future access or renewal as per the plan rules, but it does not automatically create a refund for the current billing period.
- Receipts: A receipt will be issued for every paid subscription. You can find your payment history and receipts within the app.
- Plan Expiry & Data: If your plan expires, your data remains accessible in read-only mode — it is not deleted. You can renew or upgrade at any time to restore full access.
- Coupon & Free Plans: Plans activated using a discount coupon or promotional offer are subject to the same Terms as paid plans, including all usage limits and prohibited activity rules.
4. Meaning of Unlimited Records
If your Silver or Gold plan shows "Unlimited Records", it means you can create unlimited text/database records in the supported Artist Diary categories included in that plan. These may include Artist Details, Travel Plan, Event Diary, Portfolio, Performance Details, Artist Bio, Technical Requirements, Driver Details, photo folders, photo records, and video folders where the plan shows unlimited access.
Unlimited Records does not mean unlimited storage, unlimited daily uploads, unlimited exports, unlimited file size, unlimited downloads, unlimited bandwidth, or unlimited sharing. Photos, videos, PDFs, documents, exports, downloads, notifications, connections, and other technical usage may still have fair usage, storage, security, daily, file-size, app, provider, or plan limits shown in the app, plan screen, or our official communication at the time of use.
Unlimited Records cannot be used for spam, fake entries, automated abuse, malicious files, sexual content, illegal material, or any activity that harms users, Artist Diary, Desire Software Technology LLP, Google services, Cashfree Payment Gateway, hosting providers, or applicable law. Misuse of Unlimited Records in violation of these Terms may result in account restriction or suspension without a refund.
5. Share Connections & Shared Data
Artist Diary allows users to connect with other profiles and share selected profile details, documents, media, event records, or professional information. You should share only with people or organizations you trust.
- You are responsible for checking a connection before accepting, sending, or sharing information.
- When you choose to share data with a connection, that recipient may view or use the shared information. We cannot control how another user handles data after you intentionally share it with them.
- You can change sharing choices inside the app where the feature is available, but data already viewed, copied, downloaded, screenshotted, or exported by another user may not be recoverable by us.
- Sensitive information such as identity document photos and bank details is never shared through connections automatically — only data you explicitly choose to share is visible to your connections.
- If your profile is set to Public, your profile information may be indexed by search engines. We cannot guarantee removal of cached or indexed data from third-party search engines. You can set your profile to Private at any time from your Profile Settings page inside the app.
- You can disconnect from a connection or revoke sharing permissions at any time from within the app.
6. Limitation of Liability
We want you to use Artist Diary with confidence. We implement commercially reasonable security measures to protect your data. However, there are certain things we cannot be held responsible for:
- Security Incidents: We are not liable for data leaks or unauthorized access that occur due to factors beyond our reasonable control, including your own device security, password sharing, or third-party platform vulnerabilities. If a breach occurs within our control, we will notify affected users promptly.
- Shared Data: If you connect with another user and share your documents or profile, Desire Software Technology LLP is not responsible for how that other user uses your data after you have intentionally shared it with them.
- Third-Party Actions: We are not responsible for any losses or problems arising from your interactions with other artists or entities you meet through this platform.
- Provider Services: Google Login, Google Analytics, Firebase Cloud Messaging, and Cashfree Payment Gateway are third-party services. We use them only to support app login, security, analytics, notifications, and payments, but their own terms and policies also apply.
7. User Responsibilities
You play a vital role in keeping your data safe:
- Keep your login credentials private.
- Review connection requests carefully before accepting them.
- Report any suspicious behavior to our support team immediately.
- Do not upload malicious files, fake documents, copyrighted content without permission, nudity, sexual content, abusive content, illegal material, or any file that violates Google, payment gateway, hosting, or applicable legal policies.
- You are responsible for the accuracy of all information you enter in your profile and diary. Do not enter false, misleading, or fabricated information.
- You must not use Artist Diary to harass, defame, threaten, stalk, or harm any other user or third party in any way.
8. Google Services, Analytics, Notifications & Platform Policies
Artist Diary uses Google Login, Google Analytics, Firebase Cloud Messaging, Cashfree Payment Gateway, and similar tools to provide secure login, app performance measurement, push notifications, payment processing, and service improvement. We aim to use these services in a transparent and policy-compliant way.
- We do not use Google Login data for selling personal information.
- Analytics data is used to understand app performance, errors, feature usage, and service quality.
- Firebase Cloud Messaging (FCM) is used to send push notifications for important service updates, security alerts, reminders, and relevant account information.
- Cashfree Payment Gateway processes subscription payments on our behalf, as per its own terms and privacy practices.
- Some of these services may process your data on servers located outside India, including in the United States, as per their own privacy policies.
- If any part of these Terms conflicts with mandatory law, Google policies, payment provider rules, or other applicable platform requirements, the mandatory rule will apply to that extent.
9. Intellectual Property
The design, code, and brand "Artist Diary" belong to Desire Software Technology LLP. Your personal data and the content you upload remain your property.
- By uploading photos, documents, videos, or any other content to Artist Diary, you confirm that you own it or have the legal right to upload it.
- You grant Desire Software Technology LLP a limited, non-exclusive, royalty-free licence to store, display, and transmit your content solely to operate the service for you. We do not claim ownership of your content and will not use it for any purpose beyond providing the service.
- If you delete your account, this licence ends and your content will be removed as described in our Privacy Policy.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes or legal matters arising from your use of Artist Diary will be settled exclusively in the courts of Gandhinagar, Gujarat, India.
11. Changes to These Terms
Desire Software Technology LLP reserves the right to update, modify, or change these Terms & Conditions at any time without prior notice. Any change to these Terms shall be effective immediately upon posting and shall apply to any visitor or user who has previously visited, used, or accepted the Artist Diary Terms & Conditions before the change was made. We recommend that you review this page periodically to stay informed of any updates. The "Last Updated" date at the top of this page reflects when the most recent change was made. Your continued use of Artist Diary after any changes are posted means you accept the updated Terms.
12. Your Rights Over Your Data
Your data belongs to you. At any time, you may:
- Access a summary of the personal data we hold about your account.
- Correct any inaccurate information directly in the app or by contacting us.
- Request deletion of your account and personal data, subject to retention obligations for payment and tax records.
- Withdraw consent by deleting your account at any time.

13. Prohibited Activities & Account Suspension
If your account is found to be engaged in suspicious activity, spreading misleading information, uploading malicious files, or uploading media/documents containing nudity, sexual content, illegal material, harmful content, or other misleading material, your account may be restricted, blocked, or banned from our side.
To request reactivation of a blocked account, you must send an email to [email protected] with the subject line "Reactivate My Account" and include your personal name in the message.
